Pursuit legislation, SB 719, puts public safety last

One puzzling aspect of what's happening in Californian is the introduction of Senate Bill 719 by Senator Gloria Romero, D-Los Angeles, who had asked Senator Sam Aanestad, R-Grass Valley, to be a joint author for Kristie's Law, SB 718, and in 2004 was equally, if not more outspoken than Senator Aanestad about the need for officers to follow their pursuit policies. I have read in newspaper coverage that SB 719 is basically a "counter proposal" from the California Law Enforcement community. What SB 719 proposes is to slightly change the list of elements of pursuit policy -- while making no quantitative requirements. A law enforcement agency can do pretty much anything it pleases. The bill provides for increased liability for suspects who flee (jail time) and specifically exempts agencies from liability, no matter how negligent their actions may be. In a misguided notion that victims seek financial liability from agencies, it provides for something that victims already receive from a state victims' fund, i.e., pay-outs from the California Restitution Fund for pursuit victims. Victims and their families do not seek restitution -- they seek accountability. Restitution is for stolen camcorders, not for families who have had innocent loved ones killed.
